Can the surviving spouse change the beneficiaries of an IRA Trust after the first spouse dies?

can-the-surviving-spouse-change-the-beneficiary-of-ira-trust-after-spouse-diesQ: Can the surviving spouse change the beneficiaries of an IRA Trust after the first spouse dies?

A: Yes.  This is one of the reasons why we typically recommend a combination of life insurance planning with an IRA Inheritance Trust® in the circumstances of mixed marriages where there may be children from a prior marriage involved.  You would want to make sure that the surviving spouse cannot cut out any of the deceased spouse’s children.
